1. Introduction and Acceptance of Terms Welcome to the Human-I-T web store (the “Human-I-T Online Store”) operated by Human-I-T, a Colorado nonprofit (“we,” “us,” or “our”). These Terms of Service (“ToS”) are a legally binding agreement between you and us and govern your access to and use of our website, services, and products (collectively, the “Services”). Certain features of the Human-I-T Online Store may be subject to additional guidelines, terms, or rules, which will be posted on the Human-I-T Online Store in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into these ToS. By using our Services, you agree to be bound by these ToS.
Please read these ToS carefully. By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these ToS. If you do not agree to these ToS, please do not access or use our Services.
You represent and warrant that you are of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Services and have them agree to these ToS on your behalf). If you're agreeing to these ToS on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these ToS on that organization or entity's behalf and bind them to these ToS.
These ToS apply to all users of the Services, including users who are also contributors of information, content, and other materials or services on the Website.
THESE TOS REQUIRE THE USE OF ARBITRATION AS SET FORTH HEREIN ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND ALSO LIMIT THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE.
2. Definitions In these ToS, the following definitions apply:
“Account” refers to the account you create with us to use our Services.
“Discount” refers to the price reduction offered to eligible individuals on the purchase price of select laptops and tablets.
“Eligible Individuals” refers to individuals who provide documentation proving their enrollment in government assistance programs, or proving their household income is below 200% of the Federal Poverty line.
“Products” refers to the low-cost laptops, tablets, and hotspots available for purchase on our Website.
“Services” refers to all services provided by us, including but not limited to the provision of low-cost laptops, tablets, hotspots, and internet plans.
“Website” refers to our website where you can learn more about us, our Products and Services, and where you can create an Account and make purchases.
“You” and “Your” refer to you, the person accessing or using the Website and Services.
The above definitions are not exhaustive and may be further expanded upon in subsequent sections of these ToS. In these ToS, unless it is specified otherwise.
3. Eligibility Human-I-T Online Store is committed to providing access to our products and services to all customers, irrespective of race, color, religion, sex, national origin, age, disability, or any other protected characteristic. Any individual is eligible to purchase products and services from our website.
To qualify for additional discounts on the purchase of a device from the Human-I-T Online Store (“Discount”), or to access low-cost internet plans through Human-I-T, you must provide proof of low-income status.
You can submit proof of low-income status upon creating an Account with the Human-I-T Online Store, via text message, or in-person at one of our designated locations at the time of purchase. Upon successful verification of the provided proof, you will be eligible to receive the Discount on your purchases, or enroll in low-cost internet plans.
Acceptable forms of proof of low-income status include participation in a government assistance program or proof of your yearly gross income, as detailed below:

- Need-based financial aid, e.g. Cal Grant or Michigan Tuition Grant
- Public housing assistance, e.g. Section 8 voucher
- Social Security Disability Insurance (SSDI)
- Social Security Retirement (SSR)
- Supplemental Nutrition Assistance Program (SNAP or EBT)
- Supplemental Nutrition Program for Women, Infants, and Children (WIC)
- Supplemental Security Income (SSI)
- Temporary Assistance for Needy Families (TANF)
- VA benefits for service members
*Member or enrollment cards alone are not accepted. Please provide the notification letter or a summary document that confirms you are enrolled in an active benefit.
Financial Eligibility:
If you do not receive any government benefits, you may provide proof of your gross income by submitting a copy of the previous year’s state, federal, or tribal tax return. Households that make less than 200% of the federal poverty level threshold qualify for the Discount. The documentation you provide to prove income level must display dollar amounts and the number of members in your household. Pay stubs are not accepted.
Please note:
- All documentation must be dated within the last 6 months
- Benefits must be active at the time of submission
- Members will be required to resubmit eligibility documentation every 12 months
Customers who submit proof of eligibility will be notified about their documents’ expiration date within 30 days of the expiry date. Customers who do not resubmit accepted documentation before their documents’ expiration date, or whose documents are rejected, will have their account status changed from Member to Standard User (as defined below).
While we strive to facilitate all customers, we are unable to ship items to P.O. boxes or international addresses outside of the USA and Canada due to logistical constraints. We reserve the right to cancel orders and refund payments for any orders to addresses outside of the USA for any reason including applicable laws, regulations, and operational limitations.
4. Account Registration While creating an Account with the Human-I-T Online Store can provide access to certain features, please note that Account registration is not a requirement for purchasing from our Website. Any user may create an Account on the online store. Customers who do not wish to create an Account can utilize our “Guest Checkout” feature for a streamlined purchasing process.
If you do choose to access certain features of the Human-I-T Online Store, you may be required to create an Account. When you create an Account, you agree to:
- Provide accurate, current, and complete information about yourself (“Registration Data”).
- Maintain and promptly update the Registration Data to keep it accurate, current, and complete.
- Maintain the security of your password and accept all risks of unauthorized access to your Account and the Registration Data.
- Notify us immediately if you discover or otherwise suspect any security breaches related to your Account.
- Maintain the confidentiality of your Account information.
Until documentation is submitted and approved by a Human-I-T agent, the Account type will be “Standard User”. Once approved, the Account type will change to be an income-qualified account (“Member”). If an Account is created alongside a pending order with income-qualified pricing, accepted document types must be approved within 7 days of submitting the order, or else the order will be canceled automatically. Once documentation is approved, the customer account type will change to Member (and subsequently, the user will have access to hotspot orders, internet subscription plans, and Discount pricing on future technology purchases).
Please note that all discounts and special offers are subject to availability and may be withdrawn or amended without notice at our sole discretion. Discounts and special offers cannot be used in conjunction with any other discounts or promotions, unless otherwise stated. By availing any discount or special offer, you agree to comply with any additional terms and conditions applicable to such discount or special offer.
5. Product Descriptions and Pricing The Human-I-T Online Store offers for sale a variety of new and refurbished Products including laptops, tablets, hotspots, as well as a range of non-technology items such as apparel, accessories, and other Human-I-T branded items. When we refer to “refurbished” in relation to our Products, we mean that these devices have undergone a comprehensive series of steps to maximize their physical appearance and functionality. This refurbishment process typically includes disassembling the device to check for and replace defective or missing components such as RAM, hard drives, and motherboards. All remaining data on the device is then wiped and a new operating system is installed. The device is then tested for functionality. Only after all these steps are completed is the device labeled as “refurbished”. We strive to accurately describe and display our Products on the Website. However, we cannot guarantee that all descriptions, photographs, pricing, and other information are accurate, complete, reliable, current, or error-free. In the event of an error, we reserve the right, at our sole discretion and to the extent permitted by law, to correct such error and revise your order accordingly (including charging the correct price) or to cancel your order and refund any amount charged. The prices displayed on the Website are quoted in U.S. dollars. Prices are subject to change at any time, but changes will not affect any order for Products you have already placed.
6. Ordering and Payment Terms When you wish to purchase a Product, you can either add the Product to your shopping cart and proceed to checkout or choose to use convenient payment options like Apple Pay or Google Pay which allow you to bypass the checkout process. In the checkout process, you will be asked to provide certain information, including, without limitation, your payment and shipping details. If you choose Apple Pay or Google Pay, these details will be pulled from your chosen payment platform to streamline your purchase. By placing an order, you represent and warrant that all such information is accurate, and you confirm that you are the person referred to in the billing information provided. Payment information provided during the ordering process will be collected and held until your order is approved. If you are a Human-I-T Member and have placed an order which received additional discounted pricing, it is important to note that your documentation will be reviewed for approval of the order to be completed. If the documentation is not approved within 7 days, or if payment is not received within 7 days, the order may be automatically canceled. The following payment methods are accepted by the Human-I-T Online Store: American Express, Mastercard, Visa, Discover, Stripe, Google Pay, and Apple Pay. Human-I-T reserves the right to use other payment processers at its full discretion. When you place an order, you authorize us or our third-party payment processor to charge the payment method provided for the total amount of your order (including any applicable taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or canceled. 7. Third-Party Links & Ads The Website may (i) contain links to, or integrations with, third-party websites and services (such as the third-party payment processors referenced above) and/or (ii) display advertisements for third parties (collectively, “Third-Party Links & Ads”). Such Third-Party Links & Ads are not under our control, and we are not responsible for any Third-Party Links & Ads. We provide access to these Third-Party Links & Ads only as a convenience to you, and do not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links & Ads. You use all Third-Party Links & Ads at your own risk, and you should apply a suitable level of caution and discretion in doing so. When you click on or otherwise use any of the Third-Party Links & Ads, the applicable third party’s terms and policies apply, including the third party’s privacy and data gathering practices. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction in connection with such Third-Party Links & Ads. You hereby release and forever discharge us (and our officers, employees, agents, successors, and assigns) from, and hereby waive and relinquish, each and every past, present and future dispute, claim, controversy, demand, right, obligation, liability, action and cause of action of every kind and nature (including personal injuries, death, and property damage), that has arisen or arises directly or indirectly out of, or that relates directly or indirectly to, the Website (including any interactions with, or act or omission of, other Website users or any Third-Party Links & Ads). IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542 IN CONNECTION WITH THE FOREGOING, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
8. Shipping Policy The Human-I-T Online Store offers free shipping on all devices to locations within the continental United States. Shipping times may vary depending on factors such as the location of delivery and the nature of the Product ordered. Any dates or times provided by us for the delivery of the Products are estimates only and will not form part of the contract for the purchase of the Products. The risk of loss and title for all Products purchased via the Website pass to you upon our delivery of the items to the carrier, which Human-I-T will select in its sole discretion. Please note that orders exceeding $250 will require a signature upon delivery.
9. Returns, Refunds, and Warranties 60-Day Return Policy: You have 60 days from the date the order is placed to return the device in order to receive a refund. The device must be verified to be working and in good condition to receive a full refund. If the device is damaged, Human-I-T reserves the right to offer you a partial refund based on the condition of the device. To initiate a return, please contact our customer service department. Any refunds will be credited back to the original payment method. Please note that it may take up to two billing cycles for the credit to appear on your monthly statement. 1-Year Hardware Warranty: If your computer fails within a year of when your item ships due to a hardware defect, you will receive a replacement of the same model or one with similar or better performance. This warranty does not cover damage caused by accidents, misuse, or any unauthorized repair or modification.
1 Year of Free Tech Support: One year of tech support is included with every computer purchase. You can request tech support by texting us at 562-372-6925 or by filling out a tech support request form on the Website.
Returned hotspots need to be returned in original condition. If not, then we will refund the applicable amount due to you in accordance with the chat below. For illustrative purposes, if the returned hotspot has a broken battery, then the refunded amount will be reduced by 50%.

If you rent a device from us, you agree to contact our customer service team via email at support@human-i-t.org or calling or texting 888-391-7249 to begin the return process within ten (10) days of cancelling the services related to the device. We will refund the appropriate amount to the original form of payment once the device is received and verified. We reserve the right to reduce any refund due to any missing or damaged parts of the device.
10. Intellectual Property Rights Excluding any User Content that you may provide (as defined below), all of the content featured or displayed on the Website, including without limitation text, graphics, photographs, images, moving images, sound, illustrations, software, and any other content (collectively, “Content”), is owned by Human-I-T, its licensors, vendors, agents and/or its Content providers. All elements of the Website, including without limitation the general design and the Content, are protected by trade dress, copyright, moral rights, trademark and other laws relating to intellectual property rights. The Website and the Content may only be used for your personal, non-commercial use. You agree not to use, display, reproduce, retransmit, modify, distribute, disseminate, sell, publish, create derivative works of, broadcast, circulate, display or in any way exploit any such Content, in whole or in part, whether by e-mail or by any other means, for any purpose other than for your personal, non-commercial use as set forth herein. Human-I-T reserves all rights not expressly granted hereunder. As used herein, “User Content” means any and all information and content that you submit to, or use with, the Website (e.g., the information provided to create an Account). You are solely responsible for your User Content, and you assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of your User Content that personally identifies you to any third party. If you provide us with any feedback or suggestions regarding the Website (“Feedback”), you hereby assign to us all rights in such Feedback and agree that we shall have the right to use and fully exploit such Feedback and related information in any manner we deem appropriate. We will treat any Feedback you provide to us as non-confidential and non-proprietary. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary.
11. User Responsibilities and Conduct By using the Human-I-T Online Store, you agree to:
- Use the Services only in a manner that is consistent with these ToS and all applicable local, state, national, and international laws and regulations.
- Not engage in any activity that is harmful, fraudulent, deceptive, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable.
- Not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Not violate or infringe any third party’s intellectual property, privacy, or other contractual rights while using the Services.
- Not violate any requirements, procedures, policies, or regulations of networks connected to Human-I-T.
- Not interfere with or disrupt the Services.
- Not introduce any viruses or any other computer code, files, or programs that interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
12. Privacy Policy Your use of the Website, any personal information, User Content, or other information about you collected by Human-I-T through or in connection with the Website is subject to our Privacy Policy, which is incorporated by reference into these ToS. By using the Website, you consent to receiving certain electronic communications from us as further described in the Privacy Policy. 13. Indemnification. You agree to indemnify and hold us (and our officers, employees, and agents) harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of (a) your use of the Website, (b) your violation of these ToS, (c) your violation of applicable laws or regulations or (d) your User Content. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without our prior written consent. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.
14. Disclaimers. THE WEBSITE IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, AND WE (AND OUR SUPPLIERS) EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE (AND OUR SUPPLIERS) MAKE NO WARRANTY THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE. IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE WEBSITE, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF FIRST USE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
15. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HUMAN-I-T, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE TO ANY PERSON FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, REVENUE, SALES, GOODWILL, USE OR CONTENT, IMPACT ON BUSINESS, BUSINESS INTERRUPTION, LOSS OF ANTICIPATED SAVINGS, LOSS OF BUSINESS OPPORTUNITY) HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, WARRANTY, BREACH OF STATUTORY DUTY, NEGLIGENCE OR OTHERWISE, EVEN IF HUMAN-I-T HAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES OR COULD HAVE FORESEEN SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF HUMAN-I-T AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS, RELATING TO THE SERVICES WILL BE LIMITED TO THE GREATER OF AN AMOUNT EQUAL TO THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE LIABILITY OR TEN DOLLARS ($10). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. THE LIMITATIONS AND EXCLUSIONS ALSO APPLY IF THIS REMEDY DOES NOT FULLY COMPENSATE YOU FOR ANY LOSSES OR FAILS OF ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
16. Dispute resolution Please read this section (the “Arbitration Agreement”) carefully. It is part of your contract with us and affects your rights. It contains procedures for MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER.
16.1 General. Except for actions to enforce an arbitrator’s decision hereunder, any controversy or claim arising out of or relating to these ToS, or the breach thereof, shall be determined by arbitration, remotely to the extent possible, and otherwise in California. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
16.2 Waiver of Jury Trial. THE PARTIES HEREBY WAIVE THEIR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY, instead electing that all claims and disputes shall be resolved by arbitration under this Arbitration Agreement. Arbitration procedures are typically more limited, more efficient and less costly than rules applicable in a court and are subject to very limited review by a court. In the event any litigation should arise between the parties in any state or federal court in a suit to vacate or enforce an arbitration award or otherwise, THE PARTIES WAIVE ALL RIGHTS TO A JURY TRIAL, instead electing that the dispute be resolved by a judge.
16.3 Waiver of Class or Consolidated Actions. ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS, AND CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER.
16.4 Confidentiality. All aspects of the arbitration proceeding, including but not limited to the award of the arbitrator and compliance therewith, shall be strictly confidential. The parties agree to maintain confidentiality unless otherwise required by law. This paragraph shall not prevent a party from submitting to a court of law any information necessary to enforce this ToS, to enforce an arbitration award, or to seek injunctive or equitable relief.
16.5 Severability. If any part or parts of this Arbitration Agreement are found under the law to be invalid or unenforceable by a court of competent jurisdiction, then such specific part or parts shall be of no force and effect and shall be severed and the remainder of the ToS shall continue in full force and effect.
16.6 Right to Waive. Any or all of the rights and limitations set forth in this Arbitration Agreement may be waived by the party against whom the claim is asserted. Such waiver shall not waive or affect any other portion of this Arbitration Agreement.
16.7 Survival of Agreement. This Arbitration Agreement will survive the termination of your relationship with us.
16.8 Emergency Equitable Relief. Notwithstanding the foregoing, either party may seek emergency equitable relief before a state or federal court in order to maintain the status quo pending arbitration. A request for interim measures shall not be deemed a waiver of any other rights or obligations under this Arbitration Agreement.
16.9 Courts. In any circumstances where the foregoing Arbitration Agreement permits the parties to litigate in court, the parties hereby agree to submit to the personal jurisdiction of the courts located within Los Angeles County, California, for such purpose.
16.10 Payment Dispute. If a payment dispute arises, the customer may choose to initiate a dispute through their card company. Human-I-T will then respond to the dispute using our payment processor, Stripe, which is the established channel for handling such matters. Once a dispute has been initiated with Stripe, it is considered the final step in the payment dispute resolution process, provided that both parties are free to pursue any right or remedy available to them under this ToS or applicable law.
17. Termination Subject to this Section, the ToS will remain in full force and effect while you use the Website. We may terminate or suspend your access to our Website, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the ToS. Upon termination, your right to use the Website will immediately cease. If you wish to delete your Account, please reach out to us through our Contact Us page, or via the customer service email or phone number provided on our Website. Our team will assist you in the process of Account deletion. Please be aware that deleting your Account will result in the loss of all account information and order history, and this process cannot be reversed.
